Comfort Pro's Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Comfort Pro website (comfortproca.com) and any services you purchase from The Shimazu Group LLC dba Comfort Pro (“Comfort Pro,” “we,” “us,” or “our”). By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the site or hire us.

Services We Provide

Comfort Pro offers residential and commercial services including, but not limited to:

  • Solar, security, decorative, anti-graffiti, and privacy window film installation

  • Surface protection film and turf protection film installation

  • Printed window and wall graphics

  • Automotive window tinting, paint protection film (PPF), and vehicle wraps

  • Glass polishing and scratch removal

Descriptions, images, and specifications shown on our website are for general informational purposes. Actual results, film appearance, and performance characteristics may vary depending on glass type, environmental conditions, and installation surface.

Estimates and Quotes

Written and verbal estimates are valid for 90 days from the date issued unless otherwise stated in writing. Estimates are based on information available at the time of quoting. Comfort Pro reserves the right to revise pricing if the scope of work changes, if site conditions differ from what was represented, or if additional materials or labor are required to complete the job professionally.

Payment Terms

  • Deposits: A deposit may be required to schedule work. Deposits are non-refundable if the job is canceled with less than 48 hours’ notice or if the customer fails to provide access on the scheduled date.

  • Payment due: Payment in full is due upon completion of the work unless a written payment plan has been agreed to in advance.

  • Accepted methods: We accept credit card, debit card, ACH/bank transfer, check, and cash. Merchant processing is handled through Clover.

  • Late payments: Balances unpaid after 15 days may be subject to a 1.5% monthly finance charge (18% APR) or the maximum rate allowed by California law, whichever is lower. Comfort Pro may suspend service and pursue collection, including reasonable attorney’s fees and court costs, on any past-due balance.

  • Returned payments: A $35 fee applies to any returned check or reversed payment.

Scheduling, Rescheduling, and Cancellation

  • Scheduling: All installations are scheduled by appointment. We will confirm the date, time window, and site address in writing (email or text).

  • Rescheduling by customer: You may reschedule at no charge with at least 48 hours’ notice. Rescheduling with less than 48 hours’ notice may result in forfeiture of your deposit or a rescheduling fee.

  • No-shows and access issues: If our team arrives and cannot access the property or begin work through no fault of Comfort Pro, a trip charge equal to the deposit or $150 (whichever is greater) will apply.

  • Rescheduling by Comfort Pro: We may need to reschedule due to weather, illness, supply issues, or events outside our reasonable control. We will notify you as soon as possible and are not liable for costs or losses caused by such delays.

Customer Responsibilities

To ensure a quality installation, you agree to:

  • Provide clear, safe, and reasonable access to all work areas

  • Move personal items, furniture, window treatments, and valuables away from the work area before we arrive (or request our preparation service in advance)

  • Disclose any existing film, glass defects, cracks, chips, seal failures, prior damage, or known issues with the glass, framing, or surrounding structure

  • Turn off HVAC and dust-producing systems during installation if requested

  • Ensure a responsible adult (18 or older) is present at the property for residential work, or that an authorized representative is available for commercial work

  • Ensure pets and children are kept clear of the work area for their safety

Comfort Pro is not responsible for delays, extra charges, or quality issues caused by unmet customer responsibilities.

Site Conditions and Pre-Existing Conditions

Window film is applied to existing glass. Comfort Pro is not responsible for pre-existing conditions, including but not limited to:

  • Cracks, chips, scratches, pitting, or hard-water staining on the glass

  • Failed seals or fogging on dual-pane / insulated glass units

  • Deteriorated window frames, gaskets, caulking, or weatherstripping

  • Prior film installations, adhesive residue, or damage from prior removals

  • Structural or code issues with the window assembly

We will point out visible conditions when reasonably possible before starting work, and we may decline to proceed on glass we consider unsuitable for film application.

Warranty

Manufacturer Warranty

Most Comfort Pro films are backed by a manufacturer warranty from the film maker (for example, 3M, Solar Gard, or the applicable manufacturer). Warranty length, coverage, and transferability depend on the specific film and application:

  • Residential architectural film: typically up to a lifetime warranty for the original purchaser and residence, subject to manufacturer terms

  • Commercial architectural film: typically up to 10 years for the original building owner and installation, subject to manufacturer terms

  • Automotive film: typically up to a lifetime warranty for the original vehicle owner, subject to manufacturer terms

  • Paint protection film (PPF): typically 5 to 10 years, subject to manufacturer terms

Exact warranty terms are provided by the manufacturer at the time of installation and control in the event of any conflict with this page.

Workmanship Warranty

Comfort Pro warrants our labor and installation workmanship for one (1) year from the date of installation. During this period, we will re-install or repair film that fails due to defective workmanship at no charge to the original purchaser at the original installation address.

What the Warranty Does Not Cover

Warranty coverage does not apply to:

  • Damage from improper cleaning (abrasive pads, ammonia-based cleaners on non-approved films, sharp tools, pressure washing)

  • Damage from rolling down vehicle windows or cleaning windows within the film cure period (typically 30 days for architectural film and 3 to 7 days for automotive film)

  • Scratches, punctures, cuts, or impact damage after installation

  • Damage caused by structural issues, water intrusion, seal failure, or defects in the glass itself

  • Minor imperfections (small dust particles, tiny debris, or minor edge gaps) that fall within industry-accepted installation tolerances

  • Fading or color shift on decorative films exposed to conditions outside the manufacturer’s stated use

  • Film removed, altered, tampered with, or serviced by anyone other than Comfort Pro or an authorized dealer

  • Consequential damage to windows, seals, or building components claimed to result from film installation

Warranty Claims

To make a warranty claim, contact info@comfortproca.com with your name, installation address, approximate installation date, and a description of the issue. We may request photos and a site inspection. Approved warranty remedies are limited to repair or re-installation of the affected film. This is your sole and exclusive remedy under our workmanship warranty.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, ALL SERVICES AND WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR THE EXPRESS WORKMANSHIP WARRANTY ABOVE AND ANY APPLICABLE MANUFACTURER WARRANTY, COMFORT PRO DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Performance claims regarding heat rejection, glare reduction, UV blockage, energy savings, and safety/security performance are based on manufacturer testing under controlled conditions and may not reflect real-world results on your specific glass, orientation, or building.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, COMFORT PRO’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES, THIS WEBSITE, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO COMFORT PRO FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL COMFORT PRO BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF USE, LOSS OF DATA, BUSINESS INTERRUPTION, DIMINUTION IN PROPERTY VALUE, OR CONSEQUENTIAL DAMAGE TO GLASS, SEALS, FRAMES, OR SURROUNDING STRUCTURES, EVEN IF COMFORT PRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations, so portions of the above may not apply to you.

Insurance and Certificates of Insurance

Comfort Pro maintains general liability and workers’ compensation insurance as required by California law. Certificates of insurance are available on request for commercial projects.

Intellectual Property

All content on comfortproca.com — including the Comfort Pro name, logo, photographs, videos, graphics, portfolio images, written content, and page designs — is owned by The Shimazu Group LLC or its licensors and is protected by U.S. and international copyright and trademark law.

You may not copy, reproduce, republish, upload, post, transmit, distribute, or use any content from this website for commercial purposes without prior written permission. You may share links to our pages on social media and personal communications.

Photographs of completed installations may be used by Comfort Pro in marketing materials, portfolio pages, and social media unless you request otherwise in writing at the time of the job.

Acceptable Use of the Website

You agree not to:

  • Use the website for any unlawful purpose or in violation of these Terms

  • Attempt to gain unauthorized access to any part of the website, our servers, or connected systems

  • Introduce viruses, malware, or other harmful code

  • Scrape, harvest, or otherwise collect information about other users

  • Impersonate any person or misrepresent your affiliation with any person or entity

  • Interfere with or disrupt the website or the servers and networks connected to it

Our website may link to third-party websites, including manufacturer pages (such as 3M) and social platforms. Comfort Pro does not control and is not responsible for the content, policies, or practices of third-party sites.

Reviews and User-Submitted Content

If you post a review, testimonial, photo, or other content to our website or public profiles (Google, Yelp, Facebook, Instagram, etc.) about Comfort Pro, you grant us a non-exclusive, worldwide, royalty-free license to display and share that content in our marketing. You represent that the content is truthful and does not violate the rights of any third party.

Governing Law and Venue

These Terms and any dispute arising out of them or our services are governed by the laws of the State of California, without regard to conflict of law principles. Except as provided in the Dispute Resolution section below, the exclusive venue for any dispute shall be the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there.

Dispute Resolution

Informal resolution first. Before filing any formal claim, you agree to contact us at info@comfortproca.com and give Comfort Pro 30 days to resolve the issue in good faith.

Binding arbitration. If we cannot resolve the dispute informally, any claim arising out of or relating to these Terms or our services shall be resolved by binding individual arbitration administered by JAMS or the American Arbitration Association (AAA) under their applicable consumer rules, in Orange County, California. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.

Class action waiver. You and Comfort Pro agree that any dispute shall be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative action.

Exceptions. Either party may bring an individual claim in small claims court in Orange County, California, and either party may seek injunctive relief in court to protect intellectual property or confidential information.

Force Majeure

Comfort Pro is not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, wildfires, earthquakes, storms, floods, pandemics, government orders, labor disputes, supply chain disruption, or utility failures.

Changes to These Terms

Comfort Pro may update these Terms from time to time. The updated Terms will be posted on this page with a new “Last updated” date. Continued use of the website or our services after changes means you accept the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties’ intent.

Entire Agreement

These Terms, together with our Privacy Policy and any written service agreement or work authorization you sign for a specific job, constitute the entire agreement between you and Comfort Pro regarding the website and our services.
